1. はじめに
この利用規約（以下、「本規約」）は、頭痛アラート（以下、「本アプリ」）の利用条件を定めるものです。本アプリをご利用いただく前に、必ず本規約をお読みいただき、同意いただく必要があります。
本アプリを利用することで、本規約に同意したものとみなされます。同意いただけない場合は、本アプリをご利用いただくことはできません。
2. 本アプリの目的
本アプリは、気圧変化から頭痛リスクを予測・可視化し、同じ症状を持つユーザー同士で体験を共有することで、頭痛に悩む方々の生活の質向上を目的としています。
3. 医療免責（重要）
本アプリは医療診断・医療行為を提供するものではありません。
- 本アプリの予測結果や情報は、参考情報として提供されるものです
- 体調不良や慢性的な頭痛がある場合は、必ず医師の診察を受けてください
- 本アプリの情報を信頼したことにより生じた一切の損害について、運営は責任を負いません
- 服薬の判断は必ず医師・薬剤師にご相談ください
- 緊急時は速やかに医療機関に連絡してください
今までと違う激しい頭痛、しびれや視覚異常を伴う頭痛、繰り返し起こる激しい頭痛などは、重大な疾患のサインの可能性があります。必ず医師の診察を受けてください。
4. 禁止事項
本アプリでは、以下の行為を固く禁止します。本アプリは、不適切なコンテンツや虐待的な行為を一切許容しません。
4.1 不適切なコンテンツの投稿
- 虚偽の情報や誤解を招く情報の投稿
- 医学的根拠のない治療法・薬の宣伝・推奨
- 特定の医薬品の効果・副作用について断定的な投稿
- わいせつ、暴力的、差別的、または攻撃的な内容の投稿
- 他人の権利を侵害する内容（名誉毀損、プライバシー侵害など）
- 違法行為を助長または促進する内容
- スパムや無関係な広告、宣伝目的の投稿
- マルウェア、ウイルス、その他有害なコードを含む投稿
4.2 虐待的な行為
- 他のユーザーへのハラスメント、脅迫、いじめ
- 他のユーザーになりすます行為
- 他のユーザーの個人情報を無断で公開する行為
- 健康状態を理由とした差別・嘲笑
- 本アプリのシステムやセキュリティを妨害する行為
- 複数のアカウントを不正に作成・使用する行為
4.3 その他の禁止行為
- 本アプリの機能を不正に利用する行為
- 本アプリのサービスを妨害する行為
- 本アプリの評判を傷つける行為
- その他、運営が不適切と判断する行為
5. コンテンツの責任
5.1 ユーザーの責任
- ユーザーは、自身が投稿するすべてのコンテンツ（頭痛記録、フリー投稿、コメント、写真など）に対して全責任を負います
- 投稿内容が正確であることを確認する責任はユーザーにあります
- 投稿により第三者に損害が生じた場合、ユーザーが責任を負います
- 健康・医療関連の投稿は特に慎重に行い、自身の体験以外を断定的に述べないでください
5.2 運営の権利
運営は、以下の権利を有します：
- 本規約に違反するコンテンツを事前通知なく削除する権利
- 違反を繰り返すユーザーのアカウントを停止または削除する権利
- 本アプリのサービス内容を変更または終了する権利
- ユーザーに事前通知なく本規約を変更する権利（重要な変更の場合は通知します）
6. 通報機能の利用
本アプリには、不適切な投稿を通報する機能が実装されています。
6.1 通報できる内容
- 誹謗中傷・嫌がらせ
- スパム・宣伝
- 虚偽の医療情報
- 不適切な内容
- その他、本規約に違反する内容
6.2 通報の処理
- すべての通報は運営チームが確認します
- 通報内容に基づき、適切な対応を行います
- 対応には、投稿の削除、警告、アカウント停止などが含まれます
- 虚偽の通報や悪意のある通報を行ったユーザーにも、適切な措置を取ります
7. コンテンツの権利
7.1 ユーザーのコンテンツ
- ユーザーが投稿したコンテンツの権利は、ユーザーに帰属します
- ただし、本アプリを運営するために必要な範囲で、運営はコンテンツを使用できます
- ユーザーは、コンテンツを投稿することで、運営に対して非独占的な使用許諾を与えるものとします
- 学術研究目的で匿名統計化されたデータを利用する場合は、事前にユーザーの同意を得ます
7.2 アプリのコンテンツ
- 本アプリのデザイン、ロゴ、商標、その他の知的財産権は、運営に帰属します
- ユーザーは、運営の書面による事前の許可なく、これらを使用することはできません
8. 免責事項
8.1 情報の正確性
- 本アプリに投稿される情報は、ユーザーによって提供されるものであり、運営はその正確性を保証しません
- 気圧予測アルゴリズムは研究データを参考に設計されていますが、すべての方の頭痛を正確に予測することを保証するものではありません
- ユーザーは、投稿された情報や予測結果を参考にする際は、自己の責任で判断してください
8.2 サービスの提供
- 運営は、本アプリのサービスを継続的に提供するよう努めますが、いかなる保証もいたしません
- サーバーのメンテナンス、障害、その他の理由により、サービスが一時的に利用できなくなる場合があります
- 第三者サービス（Firebase、OpenWeather など）の障害により本アプリが影響を受ける場合があります
8.3 損害賠償
- 本アプリの利用により生じた損害について、運営は一切の責任を負いません
- ただし、運営の故意または重過失による場合は、この限りではありません
9. アカウントの管理
9.1 アカウントの責任
- ユーザーは、自身のアカウントを適切に管理する責任があります
- アカウントの不正使用を発見した場合は、速やかに運営に報告してください
9.2 アカウントの削除
- ユーザーは、いつでもアプリ内の設定からアカウントを削除できます
- アカウントを削除すると、頭痛記録、フリー投稿、プロフィール情報などが削除されます
- 削除されたデータは復元できません
9.3 アカウントの停止
運営は、以下の場合にユーザーのアカウントを停止または削除することがあります：
- 本規約に違反した場合
- 不適切な行為を繰り返した場合
- 他のユーザーや第三者に損害を与えた場合
- その他、運営が不適切と判断した場合
10. プライバシー
ユーザーの個人情報の取り扱いについては、別途定める「プライバシーポリシー」をご確認ください。
本アプリのプライバシーポリシーは、本規約と同様に重要な文書です。
11. 準拠法と管轄裁判所
本規約は、日本法に準拠します。本アプリに関する紛争が生じた場合は、運営の所在地を管轄する裁判所を専属的合意管轄裁判所とします。
12. 規約の変更
運営は、必要に応じて本規約を変更することがあります。重要な変更がある場合は、アプリ内通知またはGitHubリポジトリにてお知らせいたします。
変更後も本アプリを継続して利用することで、変更後の規約に同意したものとみなされます。

1. Introduction
These Terms of Service (hereinafter referred to as “these Terms”) set forth the terms and conditions for using zutsuAlert (hereinafter referred to as “this App”). You must read and agree to these Terms before using this App.
By using this App, you are deemed to have agreed to these Terms. If you do not agree, you may not use this App.
2. Purpose of This App
This App aims to improve the quality of life of people suffering from headaches by predicting and visualizing headache risks based on barometric pressure changes, and by enabling users with similar symptoms to share their experiences.
3. Medical Disclaimer (Important)
This App does NOT provide medical diagnosis or medical treatment.
- Predictions and information provided by this App are for reference only
- If you have any health concerns or chronic headaches, please consult a doctor
- The operator is not liable for any damages arising from reliance on the information in this App
- Always consult a doctor or pharmacist regarding medication decisions
- In emergencies, contact a medical institution immediately
Severe headaches different from your usual ones, headaches accompanied by numbness or visual abnormalities, or repeated severe headaches may indicate serious conditions. Please consult a doctor.
4. Prohibited Actions
The following actions are strictly prohibited in this App. This App has zero tolerance for objectionable content or abusive behavior.
4.1 Posting Inappropriate Content
- Posting false or misleading information
- Promoting or recommending unproven medical treatments or medications
- Making definitive statements about specific medications’ effects or side effects
- Posting obscene, violent, discriminatory, or offensive content
- Posting content that infringes on the rights of others (defamation, privacy violations, etc.)
- Content that encourages or promotes illegal activities
- Spam or irrelevant advertisements and promotional posts
- Posts containing malware, viruses, or other harmful code
4.2 Abusive Behavior
- Harassment, threats, or bullying of other users
- Impersonating other users
- Unauthorized disclosure of other users’ personal information
- Discrimination or mockery based on health conditions
- Actions that interfere with the App’s systems or security
- Fraudulent creation or use of multiple accounts
4.3 Other Prohibited Actions
- Improper use of the App’s features
- Actions that interfere with the App’s services
- Actions that damage the App’s reputation
- Other actions deemed inappropriate by the operator
5. Content Responsibility
5.1 User Responsibility
- Users are fully responsible for all content they post (headache records, free posts, comments, photos, etc.)
- Users are responsible for ensuring the accuracy of their posts
- Users are liable for any damages caused to third parties by their posts
- Health and medical-related posts must be made carefully; do not make definitive statements about anything other than your own experience
5.2 Operator Rights
The operator reserves the following rights:
- Right to remove content that violates these Terms without prior notice
- Right to suspend or delete accounts of users who repeatedly violate these Terms
- Right to modify or terminate the App’s services
- Right to change these Terms without prior notice to users (notice will be provided for significant changes)
6. Use of Reporting Function
This App has a feature to report inappropriate posts.
6.1 Reportable Content
- Defamation/Harassment
- Spam/Advertising
- False medical information
- Inappropriate content
- Other content that violates these Terms
6.2 Report Processing
- All reports are reviewed by the operations team
- Appropriate action will be taken based on the report content
- Actions may include post deletion, warnings, account suspension, etc.
- Appropriate measures will also be taken against users who make false or malicious reports
7. Content Rights
7.1 User Content
- Users retain rights to the content they post
- However, the operator may use content to the extent necessary to operate this App
- By posting content, users grant the operator a non-exclusive license to use such content
- Use of anonymized statistical data for academic research purposes will be subject to prior consent
7.2 App Content
- Design, logos, trademarks, and other intellectual property rights of this App belong to the operator
- Users may not use these without prior written permission from the operator
8. Disclaimer
- Information posted in this App is provided by users, and the operator does not guarantee its accuracy
- The pressure prediction algorithm is designed based on research data but does not guarantee accurate prediction of all users’ headaches
- Users should exercise their own judgment when using posted information or predictions
8.2 Service Provision
- While the operator strives to provide continuous service, no guarantees are made
- Services may become temporarily unavailable due to server maintenance, failures, or other reasons
- This App may be affected by failures of third-party services (Firebase, OpenWeather, etc.)
8.3 Liability for Damages
- The operator assumes no responsibility for damages arising from use of this App
- However, this does not apply in cases of intentional or gross negligence by the operator
9. Account Management
9.1 Account Responsibility
- Users are responsible for properly managing their accounts
- If you discover unauthorized use of your account, please report it to the operator immediately
9.2 Account Deletion
- Users may delete their accounts at any time from the in-app settings
- Deleting an account will remove headache records, free posts, profile information, etc.
- Deleted data cannot be restored
9.3 Account Suspension
The operator may suspend or delete a user’s account in the following cases:
- Violation of these Terms
- Repeated inappropriate behavior
- Causing damage to other users or third parties
- Other cases deemed inappropriate by the operator
10. Privacy
For information on how user personal information is handled, please refer to the separately defined “Privacy Policy.”
The Privacy Policy of this App is an important document, just like these Terms.
11. Governing Law and Jurisdiction
These Terms are governed by Japanese law. In the event of a dispute regarding this App, the court with jurisdiction over the operator’s location shall be the exclusive agreed jurisdiction.
12. Changes to Terms
The operator may change these Terms as necessary. Significant changes will be announced through in-app notifications or the GitHub repository.
Continued use of this App after changes constitutes acceptance of the revised Terms.
